Florida is a judicial foreclosure state, which means the lender must file a lawsuit and win in court before a home can be sold. Being served means that lawsuit has started — but the process still takes time, and options remain.
What you received
- Summons: tells you a case has been filed and how long you have to respond.
- Complaint: the lender's lawsuit explaining what it claims.
- Lis pendens: a public notice recorded against the property that a lawsuit is pending.
The 20-day deadline
In Florida you generally have 20 days from service to file a written response with the court. If you don't respond, the lender can ask for a default, which can speed up the case.
